Plympton BOS approves marijuana agreement

The Plympton Board of Selectmen met remotely on Monday, September 13. The Board of Selectmen voted during the meeting to approve a Host Community Agreement (HCA) with marijuana distributor Sweetgrass Farms, LLC. Town Administrator Liz Dennehy said she and Selectmen Vice Chair Mark Russo had taken the lead on the negotiation with Sweetgrass owner and area native Nick Rizzo. The cultivation site would be at 77 Spring St. Russo said, “the industrial park is the exact right place for this project.” Russo also said, “I feel really good about this end product… I think this is a document that is fair to both sides.” He also called Rizzo a “fair but energetic negotiator” and said, “I think we’re dealing with really respectful, talented people who want to do the right thing.” Built into the contract is a $5,000 annual contribution to a local charity or non-profit to be selected by the town.  Rizzo said that he considers that to be a minimum noting that he hopes to be able to contribute even more. The Selectmen voted unanimously to approve the agreement.

Police Chief Matt Clancy attended the meeting to share with the Selectmen his review and analysis of the Department’s use of force over the last year. The review is a requirement for a certification and accreditation program Clancy has entered into. “It’s just another piece of the transparency that we’re building,” Clancy explained. He said he expects to see it become a requirement in Massachusetts eventually.

Clancy told the Board the Department has reviewed their use of force policy three times in the last two years, noting that the amendments were minimal as their policy was already progressive. He said that Massachusetts has come out with what they consider to be a model policy and that the Plympton Department’s policy was nearly identical. The report is generic and includes incidences but does not include names. Clancy told the Selectmen there were no complaints of excessive force and no injuries. Drawing a taser and engaging in a pursuit both qualify as use of force. “I’m very happy with how things were handled… I think the officers showed a tremendous amount of restraint in a number of situations,” Clancy said. The Selectmen thanked him for his hard work on this initiative. Selectmen Chair Christine Joy said, “You think this stuff doesn’t happen in Plympton, it does… it’s nice to know that it was handled so well by our officers.”

Clancy will be leaving the Plympton Police Department to serve as Chief of the Bureau of Capitol Police in Maine. The Selectmen voted to appoint Scott Benton to serve as interim Police Chief as of October 4.

Joy provided an update on the Carver Urban Renewal Plan as she attended the meeting that was held on the project on Sept. 7. She said her main takeaway was that Carver still has quite a lot of work left to go in the process. She said the developer performed a balloon test that revealed the extent of the scope of the project. Joy said that they estimate that 75 households in Plympton will be affected by the project. Carver has promised to keep Plympton abreast of all meetings.

Selectman John Traynor requested a discussion on the uses of the Old Townhouse. He was particularly concerned with it being utilized by the Council on Aging (COA) for fitness classes. He said he would like to see the building outfitted with a better Wi-Fi lock. Director of Elder Affairs Colleen Thompson called the current lock “kind of a farce.”

Joy suggested that there may potentially be better places to hold such classes noting that the town has a pending lawsuit against them from someone that fell. Russo said that they should discuss appropriate uses for the building further during another meeting. Thompson argued that building needs to be used if insurance is being paid on them. She countered Joy’s argument saying that it felt like a town group was being asked to seek a private location to engage in town sponsored events. Resident Shannon Maxwell said, “You’d have a group of very, very happy women if we could go back to working out in a building this winter and not in our bedrooms.” The Selectmen voted to approve a three-month trial use of the building for the COA fitness club from October 1 through December 31.

Dennehy provided the Town Administrator’s update. She said that she met with the Kingston Town Administrator, the Plympton and Kingston Police Chiefs, the Plympton Highway Superintendent, Police Officer John Sjostedt, and the Kingston DPW Director to discuss possible heavy truck traffic exclusions on Ring Rd. Plympton would need Kingston’s approval to move forward with the process. Dennehy said Kingston said they are not interested at this time as they had concerns that it could result in such traffic being redirected down other roads in their town, particularly Elm St. She said they are, however, open to future conversations. Regarding the Main St. component, Dennehy said that the Highway Superintendent wants to verify with MassDOT that implementing the exclusion would not preclude them from grant opportunities including roadwork.

Dennehy said she had a successful meeting with Habitat for Humanity. She said they have an environmental professional on their team who will look through some of the town’s data on possible lots in an attempt to narrow it down to a piece of land in order to proceed with a project. The town would need to verify before moving forward on a project that there were no other non-profits who might be interested in the land.

Dennehy said she has been in communication with The Greater Attleboro Taunton Regional Transit Authority (GATRA) in order to iron out what the level of service they would provide would look like. She noted that the town would need to be sure they could afford it. Finally, Dennehy told the Selectmen that the town was still hovering around a three percent positivity rate for COVID.

During their traditional rants and raves, John Traynor said that the COA is having an issue getting enough drivers for their Meals on Wheels program. He called his rave a sad one saying, ““Chief Silva and his crew did a wonderful job on the 9/11 ceremony.” Both Russo and Joy said their raves were for all of the work being accomplished in town and the progress being made. Russo said, “with patience, progress comes.”

Mask mandate equals persecution

The Halifax Elementary School Committee met on Monday, August 30. The meeting began at the elementary school but was moved across the street to the Town Hall after several meeting participants refused to put on masks and the Superintendent and other school administrators had to leave to avoid being in violation of the Department of Elementary and Secondary Education’s (DESE) mask mandate. Halifax does not mandate masks in public buildings hence the location change. School Committee member Lauren Laws chose to join the meeting remotely after the move.

Chair Summer Schmaling began the meeting by opening it to public participation. Ashley Gregor of Middleborough took the opportunity to speak. Gregor began, “I’m here because I strongly oppose the masks.” She continued, “I think in the long run this is really going to psychologically affect the kids. They don’t understand, they went all summer without masks now they’re going to step back into the school system and have to put a mask on… I’m sad that there’s not a lot of Halifax parents here tonight. I think that you guys need to be brave and you need to stand up… there’s a big home-schooling community in Halifax; there’s a lot of people that will support you and stand up for you and this isn’t right and I’m just here to stand and say this isn’t right – no masks for the kids.”

Another parent took to the microphone to quote from the Holocaust documentary The Last Days. She read, “People wonder how is it that we didn’t do something. We didn’t run away, we didn’t hide. Well, things didn’t happen at once. Things happened very slowly so each time a new law came out or a new restriction, we said well, just another thing – it will blow over. When we had to wear the yellow star to be outside, we started to worry.” Using her own words, she then asked the School Committee, “sound familiar?” Another woman took to the microphone saying, “I just want to say, my grandchild is in the public schools and I will not allow him to be muzzled because that’s exactly what this is and it is a health risk.” She continued, “It increases your chance of getting sick. The viruses fit through the mask itself so you’re only increasing the risk of getting sick – you’re going to notice a spike in the children getting sick this year. Why? Because of the muzzle.”

Schmaling then addressed those gathered saying, “I just want to make one statement and I want to be very clear as to why we’re sitting in this room right now. I do not agree with masking our children at all and I’ve been very, very outspoken about it.” She pointed out that the School Committee had agreed to rescind the previous year’s masking policy prior to the DESE mandate. She continued, “I was not aware that by holding the meeting in the Elementary School tonight that it would put the license in jeopardy of my Superintendent, my Assistant Superintendent, my Principal, and my Assistant Principal… I agree with a lot of what was said here tonight, and I want you to know that I will continue to fight for our kids.” She said she believed it to be an overreach of DESE and the Education Commissioner to mandate masks. Finally, she said that her reasoning for moving the meeting was to include the administrators and conduct all necessary business.

Halifax Elementary School Principal Kayne Beaudry gave an update on the staff meeting that he described as “a good vibe, good energy, lots of positivity there.” Beaudry thanked the custodians for all their hard work over the summer getting the classrooms set for the school year. “We can’t thank them enough for everything that they did,” he said. He also thanked the office staff for their work over the summer. “There’s a lot that goes into it behind the scenes; I don’t think that people realize it,” he explained. Regarding enrollment he said that it had been in flux right up to the first day. As of that day, the number stood at 564 students. There were four new staff members including a sixth-grade teacher and a new kindergarten teacher. He said there are still two open positions in the school. Beaudry also told the Committee that there are fans and air purifiers in every classroom.

Assistant Superintendent Ryan Lynch provided some grant updates saying that they closed out their ESSER 1 grant that was established as part of the Education Stabilization Fund in the CARES Act. Lynch said they had successfully applied for ESSER 2 that allots $106,000 to Halifax for the next year or so with the aim being to support missed teaching and learning opportunities. He said they were looking for input from teachers and staff regarding supports needed by students. Lynch also said that the school was granted a wellness coach by DESE.

Superintendent Jill Proulx touched upon the welcome back day for all staff noting that it was the first time that not only all faculty, but all staff was invited to the meeting. “The focus was on celebrating the efforts of those staff members and faculty members who came together to try to recreate the way that we teach and learn to the best of our ability,” Proulx said.

Proulx provided an update on guidance from DESE and the Department of Public Health (DPH). She reminded everyone that remote learning would no longer be recognized by the State, unlike last year. Proulx said that earlier that week, DESE had granted Education Commissioner Jeffrey Riley authority to mandate masks for all public K-12 students through at least October 1. After October 1, the mask mandate may potentially be lifted for all vaccinated students and staff if the school meets a certain vaccination rate. Proulx said she was told that rate would be eighty percent. Proulx said they anticipate hosting vaccination clinics at the Kingston Intermediate School in September.

Proulx told the Committee that there are no social distancing requirements this school year. She also said that there will be a test and stay program implemented. “If you are a close contact, you would have the option to stay in school and be tested daily… as long as you are asymptomatic,” she explained. Schmaling asked if a parent opted out of the free testing, would they then have to quarantine. Proulx said they would have to quarantine for seven days from the date of exposure. Students would be sent work that they can complete at home. Proulx read, “close contacts are defined as individuals who have been within six feet of a COVID 19 positive individual while indoors for at least 15 minutes during a 24-hour period.” Individuals who are fully vaccinated and asymptomatic are exempt from testing and quarantine. Other exemptions include asymptomatic individuals who were exposed but masked and three feet apart as well as those on buses that were masked while windows were open. Another exception is for asymptomatic individuals who are exposed within 90 days of their own positive COVID test.

A member of the School Committee asked what would happen if a student without a viable exception refused to wear a mask. Beaudry said that they would likely have a conversation with the school nurse and himself and if the behavior continued the caregivers would have to become involved. “Hopefully at that point we would come to the conclusion that it’s a State mandate,” he said. Schmaling said, “I personally feel very strongly, I don’t know how the rest of the Committee feels, that if anyone is going to have a conversation with my child, who is a minor, regarding their health or their opinion on something and it’s pertaining to anything medical, I need to be present as a parent so I think that we should, perhaps, entertain a policy.” She went on to say that the policy would stipulate that if any staff members are to have conversations regarding masks, vaccines, etc. that a parent needs to be present.

Committee member Gordon Andrews argued that wearing a mask is a requirement to be in the building and not a medical issue. He argued that anyone in violation of that requirement would have to go through the chain of command, beginning with the teacher and ending with the Superintendent if still not in compliance. Schmaling disagreed vehemently and said, “I do not think that our least vulnerable population should ever be masked; it’s a hindrance to their learning and their education. They’re not effective, they’re not health measures; these cloth masks do nothing for anybody but make their kid have a bacteria filled wet rag on their face all day.” Committee member Lauren Laws who was zooming into the meeting argued that transmission in schools was negligible last year due to the mask wearing. Schmaling loudly countered, “That’s not true. That’s not true. You’re just making things up! You’re making up talking points and it’s not true.” Laws said, “We did not have a lot of transmission in school, that’s a fact.”

Committee member James Keegan steered the conversation back in the direction of whether a policy should be put in place requiring caregivers to be present for conversations regarding mask violations. He said that if those conversations were to take place absent a caregiver, they should not include discussions on health. “I want to make sure that teachers and staff in the school who may have very strong opinions one way or another, do not bring those opinions into the classroom,” Keegan said.

Schmaling brought up an incident in a classroom where she says a teacher asked the students to raise their hands if vaccinated calling it “highly inappropriate.” Laws pointed out that the students at the elementary school are not even yet eligible to be vaccinated. Schmaling raised her voice crying, “thank God for that.” She told Beaudry, “I am like full on Momma bear mode with this issue – full on and I will be pissed if my kid comes home and tells me that they got cornered and felt intimidated, coerced, bullied, discriminated against.” Regarding teacher and administration intervention, Laws said, “if they are enforcing a policy, that is all we are talking about.” Keegan was very adamant that he does not want to see any teachers or staff harassing students. Schmaling claimed to know of a Halifax Elementary School teacher who has been vocal about how she would handle disciplining a child not wearing a mask. Keegan asked if there would be progressive discipline for a staff member who was handling the situation inappropriately.

Keegan appeared confused as to whether the School Committee could lift the mask mandate for their school despite the DESE requirement. Silver Lake’s attorney corrected him and said that option only existed prior to the DESE mandate. Fellow committee member Jennifer Carroll expressed her disapproval of the mask mandate. She said that students would be confused as to why they were allowed not to wear a mask at various venues over the summer only to be told they must wear one while in school. Laws countered that things have changed in the last several weeks citing the more contagious nature of the more dominant Delta variant as one of the things that has changed. Laws said her own family is all fully vaccinated but said they went from not wearing masks to wearing masks indoors again. “Looking at how things have changed and that there is more spread again, I truly believe this is what will keep our kids in school,” Laws said. Schmaling asked Laws sarcastically, “Could you please send me some information on where you’re finding these magic masks that are FDA approved because I can’t find them anywhere. I even looked in my lab; I work in a virology/genetics lab.”  Laws then asked Schmaling why she believed masks were being mandated. Schmaling said, “Because it’s a virtue signal.” Both Keegan and Schmaling then said, “We know why.” Schmaling continued, “That’s silly to even ask that question” to which Laws pressed her to further explain her reasoning. She did not. Carroll then interjected saying that the masks being worn clearly state that they will not protect you against viruses. Carroll said that if masks are being mandated, they should be proper masks and Schmaling added that they would also need goggles and a hazmat suit.

Schmaling also suggested that the School Committee send a letter to the State asking that the power to mandate masks be placed back under local control. Laws asked the attorney if it would have to be signed by everyone and was told it would not but that the letter would be sent if the majority of the Committee voted in favor of it.

Plympton says ‘No’ to trucks

The Plympton Board of Selectmen met virtually on the evening of Tuesday, August 23. Chair Christine Joy introduced Bill McNulty with the Old Colony Planning Council (OCPC) to discuss ways to deal with heavy truck traffic in town, particularly on Main St. and Ring Rd. McNulty said originally they were discussing establishing safety zones but have begun looking at heavy commercial vehicle exclusions in order to help mitigate cut-through traffic. He showed a map with two options, one that would look at Main St. alone and another that would involve Ring Rd. and require the cooperation of the town of Kingston.  The OCPC performed traffic counts on these roads back in March. He said that while the numbers were relatively low on Ring Rd., they did include a high percentage of trucks. He noted that “speeds were a little high” as well. Main St. was seeing about 2500 vehicles per day with a high percentage of those being heavy truck traffic. The percentage seen was somewhere between 14 and 16 percent. The heavy truck exclusion as shown on the map would include Main St., Ring Rd., Crescent St., and Upland Rd. McNulty suggested considering adding Center St.  and Maple St.

McNulty said the first step would be for the Board of Selectmen to vote on the traffic exclusion and then to send a letter to the Massachusetts Department of Transportation (MassDOT). Selectman Mark Russo said he was in favor of the Main St. exclusion as well as Ring Rd. but recommended getting started on approval of the Main St. one while waiting for approval by Kingston for Ring Rd.

Selectman John Traynor asked, “Once we exclude them, what happens if they continue to use it?” “Most trucking firms would avoid it because they know that getting caught… can carry heavy fines,” McNulty explained. He further said that the GPS systems used by the trucking firms would have the updated information regarding the truck exclusions. McNulty also said that approvals from MassDOT are usually fairly quick and completed within a month. The Selectmen voted to seek the heavy traffic restriction zones as outlined by OCPC. They also voted to move forward with getting Kingston’s approval.

Plympton Treasurer/Collector Christine Kelly met with the Selectmen to discuss updated financial policies and procedures. “Basically, I’m just looking to put our procedures in writing per the auditor,” Kelly explained. She said the changes would only effect turnovers to the treasurer and grants. The Selectmen voted to approve the changes.

The Selectmen voted unanimously to approve a few agreements including the Agreement of Services with Habeeb and Associates for the Townhouse roof project. They also discussed the agreement for grant funded services for the MVP Winnetuxet River Corridor Open Space Project with Southeastern Regional Planning and Economic Development District (SRPEDD). Russo said, “Essentially what this does is give us Bill Napolitano, the trails and watershed manager for another year; Bill is amazing… is unbelievably patient and kind in holding our hand and this is great that we get him for another year.” The Board voted unanimously to approve the agreement.

The Board also discussed issuing a proclamation to designate September Suicide Awareness Month. Joy said they had received correspondence from Plymouth County asking the town to make the adoption. Joy said she sent an amended document to the other Selectmen. “Basically, it just kind of got rid of some of the language that made me think it might be kind of an unfunded mandate…. I thought it was good stuff but it was asking the town to take some action that I didn’t know we are in a position to do at this time,” Joy explained. The Board voted unanimously to adopt the document as amended by Joy.

Town Administrator Liz Dennehy provided an update. She said they are in the process of closing out the latest round of Green Communities grant funding. She said they are hopeful they can purse the boiler project at Dennett Elementary with the next round of grant funding. Dennehy also told the Selectmen that the Hazard Mitigation Grant is also close to being closed out.

The Selectmen provided their rants and raves for the past two weeks. Traynor said his was a “resident rave.” He said he felt there should be a rave for all the signs around town for the graduating seniors. Another rave he had was for two small, book houses or tiny libraries being paid for and soon to be placed throughout the town with the potential for more. Russo said his rave was for the progress on the truck exclusion. His other rave was for the progress made with the appointment process. Joy said her rave was for the great job being done by the financial team.

The Board also took a vote to rescind all prior appointments to the Emergency Management team. The Selectmen voted to reaffirm naming the Town Center Campus Committee, formerly known as the Public Safety Building Committee, to the Town Properties Committee. Questions remain for new fire station

The Town Properties Committee met on Wednesday, August 18. It was a joint meeting with the Plympton Selectmen. Members of the Plympton Finance Committee were also in attendance.

“The Town Properties Committee has spent the last year plus working on sort of a vision overall for the campus,” Chair of the Town Properties Committee Jon Wilhelmsen told those assembled. One of the main objectives for that campus plan is figuring out the placement of the new fire station. Wilhelmsen shared what he referred to as a “high level, notional drawing of the grand plan if we are able to put that in place.” The new, proposed fire station would be behind the new police station on Palmer Rd. The drawing also showed a proposed fix for the parking area for the library and Townhouse. He said the main entrance would convert from two to one driveway. Wilhelmsen said the existing fire station would remain and over time be converted into a community center that would include the Council on Aging (COA). Regarding the ball fields, Wilhelmsen said they are looking into doing some work to Harry Jason Park that involves working with both PAYS and the Recreation Committee on a long-term plan.

The new fire station was described as being a 3-bay, drive through, modern facility that would provide an appropriate space to house, maintain, and provide for a number of things. Those things include the safety and security of fire personnel and visitors, apparatus, supplies and gear, administrative and personnel space, and community interaction. Included in that community interaction would be a space to be used as a public medical room where vaccines and other medical services could be rendered. The hope would be to also have a public conference space that could be utilized for many things including a public cooling/warming area.

Also addressed within the meeting was the why behind the building of a new fire station. The current building is non-compliant with current OSHA regulations and poses physical and occupational safety concerns due to significant space and facility constraints. Fire Chief Stephen Silva pointed out that while previously they were not, the State is now mandated to be OSHA compliant. He said that regulations specific to carcinogens off gassing from gear have changed greatly since the building was first built. Supply management challenges also exist as supplies are spread across four different buildings, containers, and trailers across three different locations in town. “You’ve entrusted me with millions of dollars of equipment that we cannot properly house and that is just not right,” Silva said.

The timeline was also discussed with architect selection, programmatic and schematic design, infrastructure assessment, and cost estimates outlined to occur between October 2020 and April 2021. Final design, bidding, construction, and occupancy is tentatively scheduled between July 2021 and December 2022.

Regarding cost, Wilhelmsen said the goal would be to utilize existing funds and said they were not intending to do an override. The hope would be to use modular construction and/or leverage existing design plans. The town would also hope to take advantage of lower interest rates and intends to limit the impact of future increases in building costs. Plympton may also be able to potentially take advantage of Federal infrastructure funds with the American Rescue Plan Act of 2021 (ARPA). The total project cost is estimated at $6 million.

Selectman and Town Properties Committee member John Traynor said that the Committee has had two financial team meetings the most recent being that morning with the Town Administrator, the Town Accountant, the Town Treasurer, and the Assessor. Traynor said that as of June the amount in the Capital Stabilization Fund was $1,078,800. A Mass Municipal Depository Trust (MMDT) was established in 1996 and has never been used. The MMDT currently stands at $207,600. There is $803,500 in the Regular Stabilization Fund. The use of the funds must be approved by a two-thirds majority at town meeting.

“If we were to take a 30-year bond for $6 million at current interest rates it would give us a bond repayment each year of $324,000,” Traynor said regarding the new fire station costs. The current police station debt is set to run through 2040. “We’re in pretty good shape financially. The question is can we do a fire station that we can do and still have money left over because we know there will be things like new roofs and other issues we’re going to have to address as we go through the years,” he explained. Selectmen Chair Christine Joy asked, “So you’re saying that based on the $6 million number that we would be able to afford this just on the additional monies we’re getting for Capital Stabilization; we wouldn’t have to dive into it; it would basically just be self-sustaining from what we’re taking in?” Traynor confirmed that understanding was correct.

Joy asked about whether the Assessor had been brought into the conversation regarding the incoming funds into Capital Stabilization. “If they were to go down significantly, we could get ourselves into a pickle,” Joy pointed out. Traynor said they had, noting, “In fact, Sysco is currently assisting at $52 million… and they upped it to… over $60 million.” He did note that some of that would be abated but said that there should be an uptick, if anything. “One of the things that is troubling to the Finance Committee from time to time is there’s no guarantee that Sysco will be there in twenty years,” Chair of the Finance Committee Nathaniel Sides said. “But somebody’s going to be there Nate,” Traynor said. Sides insisted that you can’t know that and pointed to plenty of empty buildings up and down the East Coast. Silva countered saying, “We are the fastest section of the State of Massachusetts that is growing – the South Shore and the South Coast area and Massachusetts is one of the fastest growing economies nationwide despite everything that is going on.” Traynor furthered that all they were looking for at the moment was the go ahead to move forward with a feasibility study. The money for the study would have to be approved at special town meeting.

Joy said that she would rather see something like this handled as part of the annual town meeting rather than as part of a special. Wilhelmsen said the push to put it as part of the special had to do with concerns over price increases. Town Properties Committee member Ross MacPherson said, “What I’m seeing in construction right now is, forgetting the COVID related things, we are seeing a ton of money come into the infrastructure space and that is just going to tap the existing resources and like we had with the police station, what we really need to find is the contractor that needs this project more than would like to have this contract… if we wait too long, we may not have a bid that we can take.” He further said that while material prices are starting to level off, labor prices are increasing. Town Administrator Liz Dennehy added that if they at least had a design in the works sooner rather than later they may be able to at least partially fund a new septic system with ARPA funds. “There is kind of a larger scale benefit to having some of this feasibility and design work done and out of the way,” she explained.

“This is kind of ten years in the making, I have sat in on the various permutations… I think we’ve kind of been spinning our wheels. We know that sooner or later we’re going to have to do something with the fire station. I’m in favor of moving ahead with this,” Selectman Mark Russo said. He continued, “We are gaining nothing by just sitting and waiting.” He called it “amazing” that it could potentially be possible to build a new police station and a new fire station in such a short amount of time without increasing the tax rate. “I think we have to make clear that this is not committing to a new station; it is committing to spending some money to see if this will work,” Russo said.

MacPherson took a moment to address why the option of rehabbing the current station was not being explored. He said there are always unknowns when rehabbing and said that the town would have to commit to those. He also noted that the Fire Department would have to be moved elsewhere for the duration of the construction.

Joy made a motion that the Selectmen support the efforts of the Town Properties Committee in committing to a feasibility study on a new fire station. The Selectmen voted unanimously to approve the motion.

Following the discussion on the Fire Station, the Committee then turned their attention to the Harry Jason Park. MacPherson said he met with Plympton Athletic Youth Sports (PAYS) who expressed to him some general needs and wants. “They thought that having everything centralized at Harry Jason was a great end goal,” he said. MacPherson told the Committee that currently U-10 and U-12 share a soccer field at the Dennett that has to be striped differently depending on which age level is utilizing it. He also said that the youngest players are using the outfield of the baseball/softball field for their games. When asked what they would like to have in a perfect world, PAYS said they would like to have a major/minor league field, a larger sized little league field, a U-14 size soccer field that would also serve U-12, and a second soccer field for the U-8 and U-10. MacPherson said he believed there could be some repurposing done as well as some tweaks to the fields at the Dennett. Wilhelmsen pointed out that any new fields would require bringing in electricity and water. Colleen Thompson asked about the possibility of incorporating some adult facilities such as tennis courts at the park. “I think that there can be, in the grand plan of Harry Jason, some better walking trails or things that can be utilized,” MacPherson said. He said that since PAYS is youth related, the Recreation Committee would have to work with them on adult uses.

A quarter of Halifax still not vaccinated

The Halifax Board of Selectmen met in-person on August 10. Fire Chief Jason Viveiros met with the Selectmen to discuss COVID. “Obviously things have not gotten better, they have gotten worse during the last few weeks,” Town Administrator Charlie Seelig said. He further said that the number of cases in Halifax have increased to the levels last seen in April. He said the Board would need to reconsider whether they wanted to review policies related to COVID including the masking policy in town buildings. Selectman Chair Gordon Andrews updated the Board that the schools made a decision to follow the recommendations of DESE, the CDC, and the DPH in requiring rather than mandating masks.

Seelig provided vaccination statistics for Halifax youth saying that for 12–15-year-olds the rate stood at 38 percent and 49 percent for ages 16-19. The rates tended to increase with the age of the residents. “A quarter of the population of Halifax is not vaccinated yet,” Seelig said. Andrews said he was not comfortable making a change to the masking policy at the moment. Viveiros said he was watching different towns that were starting to implement mask mandates. “I think waiting another week or so and reevaluating it is fine,” he said. Viveiros also discussed the possibility of receiving tests from the State to be administered. The Director of the Council on Aging said that as of today they have begun recommending masks as they are meeting in small quarters. She said everyone was very receptive of it and masks were available on site.

Andrews recused himself but the rest of the Board unanimously voted to appoint Chris Carmichael as Alternate Building Inspector for Certificates of Occupancy. The Board also voted to appoint and reappoint the list of election workers through June of 2022.

There was also a continuation of a discussion on the Zoning By-Law Review Committee from a previous meeting. It was agreed that the Board would like to see as part of that Committee, the Building Inspector, a member of the Finance Committee, a member of the Board of Selectmen, and two members at large.

Andrews recused himself from the rescheduling of a new public forum for a Host Community Agreement (HCA) with Green Earth Cannabis. Andrews’ father owns land within close proximity to the proposed site. The Board had previously voted in June not to enter into an HCA with the company but agreed to rescind its previous vote and hold a new public forum to avoid litigation against the town. The Board agreed to hold the forum on Monday, August 30 at 7 p.m.

Seelig told the Board there was a petition article submitted by August 10 with more than 100 signatures. The proposed zoning by-law amendment would restrict the number of marijuana dispensaries in town to one. Seelig said the Selectmen could submit it to the Planning Board that night but noted it would still need a public hearing. “It’s doubtful it’s going to be voted on at the Town Meeting on September 8,” Seelig said. The Selectmen voted unanimously to send it onto the Planning Board.

Seelig told the Board that the Council on Aging (COA) was interested in potentially increasing its number of members. Seelig also told the Selectmen that he had received a talent bank form for Ivy Matheny who was interested in working with the Council on Aging and potentially as the Veteran’s Agent.

Town Accountant Sandra Nolan and Recycling Co-ordinator Sue Johnston met with Selectmen to discuss the recycling fee process including abatements. Nolan said that one of the big issues is that they want to ensure that residents are recycling. Nolan said that this year they had at least 12 households who had their recycling fee abated and then tried to use the recycling center halfway through the year. “I think that people don’t understand that that recycling fee is not just for curbside; it also supports the whole functioning of the recycling center,” Nolan said. She continued, “It is really a huge benefit to the townspeople as far as having a place you can go with your old couch.” She called the fee “nominal.” Andrews summarized the conversation saying it would be a $50 recycling bill for FY2022 with a 60-day abatement window.

Library Director Jean Gallant and the Library Trustees had an appointment with the Selectmen in order to vote to fill a vacancy on the Trustee Board. There were two candidates interested. The Library Trustees made a motion to appoint Susan Hill. Both the Selectmen and the Trustees voted unanimously to appoint Hill to fill the remaining vacancy.

Seelig went over some of the articles on the upcoming Town Meeting warrant including one by the Chief of Police to take the town out of civil service. There is another for additional money needed by Silver Lake in the amount of $130,890. Seelig said it was the difference between what was appropriated at Town Meeting and what is needed. The Water Department also needs to put more money in their return line item. Article 17 would remove the buffer between marijuana establishments and liquor pouring establishments. Article 19 is in regard to traffic safety. Seelig said he would need to speak with Highway Surveyor Steve Hayward to find out what exactly the article would and would not cover with respect to things like sidewalks.

Tyler Nordgren met with the Selectmen regarding his application to be appointed to the Historical Commission. Asked by Selectman Ashley DiSesa why he wanted to apply, Nordgren explained, “I like historical sites and I would like to help preserve them as they are important to the community.” Nordgren, who has lived in town since he was 8, said he hasn’t recently attended Town Meeting but plans to attend the next one. The Board voted unanimously to appoint him to a three-year term.

The meeting ended with the official swearing in of Michael Boncariewski as a full-time Police Officer.

Multiple Open Meeting Law complaints charged against BOS

The Halifax Board of Selectmen met in-person on August 11 with the exception of Selectman Ashley DiSesa who joined remotely. On the agenda was a number of complaints that had been filed.

The first order of business was dealing with the July 20, 2021 open meeting law complaint from John Day. According to Chair Gordon Andrews the complaint read that a meeting was held on that date and the only agenda item listed was the appointment of the building inspector and a possible appointment of a temporary building inspector. The complaint further read that the Board went immediately into executive session coming back into open session at 7:30 when they entertained a motion to adjourn until that Friday at 9 a.m.

“The lack of any substantive discussion coupled with individual Board member’s collective expectation that they would be meeting at 9 a.m. on July 23 to discuss the building inspector’s position indicated the Board members had discussed the building inspector matter in executive session despite its placement on the open meeting agenda. This violation appears to be intentional given the conflicts of interest by virtue of Mr. Andrews’ pending lawsuits that he has filed against the town and town officials including Robert Piccirilli,” the complaint from Day read. Also included in the complaint dated August 5 was that the Town Administrator Charlie Seelig was on vacation that day and did not attend and the Administrative Assistant was told not to attend as Andrews would handle the minutes.

Andrews said that he would recommend that the Board have the complaint handled by town counsel Brooks and DeRensis. DiSesa made the motion, Selectman Troy Garron seconded it, and the Board voted unanimously to do so.

A second complaint from Day was filed regarding the July 23 meeting. The complaint, which Andrews read, stated that once again Seelig and the Administrative Assistant were not present and the Board went into executive session at 11 a.m., returning to open session at noon. It noted that Andrews recused himself from the building inspector discussion leaving Garron as Vice Chair to take control of the meeting. The complaint described Garron as “visibly nervous and remained so throughout the rest of the meeting.” It noted Garron’s insistence that Piccirilli remained the best choice for building inspector.

Again, Day’s complaint said that there was strong suspicion that the Board had discussed the matter in executive session and had decided on hiring James Perry as the building inspector due to the rapidity in which the events unfolded in open session. The complaint asked that any discussion regarding the position that was had during executive session be disclosed to the public. It also asked that an explanation be given as to why the Administrative Assistant was not the one taking the minutes. Garron made a motion that again, they refer the complaint to Brooks and DeRensis. It was voted through unanimously by the Board.

The next item on the agenda was another open meeting law complaint regarding the July 23 meeting, this one by Barbara Gaynor. The complaint referenced the June 23 meeting during which the Board of Selectmen interviewed five applicants including Piccirilli, who at the time was the current building inspector. The complaint claimed that at no time did the Board explain how they came to their decision to hire Perry into the position and asked that they disclose that information to the public.

The final complaint dealt with during the August 11 meeting was in regard to the June 29 meeting during which the Board of Selectmen voted to appoint Brooks and DeRensis as Town Counsel. The complaint said that Brooks and DeRensis were asked to investigate the complaint but noted that they have a financial interest in the matter. Andrews read a motion stating, “As the appointing official which is the Board of Selectmen as required by Massachusetts’ General Laws Chapter 268a, Section 19 I have reviewed the particular matter and the financial interests identified above by the municipal employee; I have determined that the financial interest is not substantial as to be deemed unlikely to affect the integrity of the services by which the municipality may expect from the employee.” The Board then voted unanimously to have Brooks and DeRensis continue on with the investigation into the open meeting law complaint.

The final complaint to be handled during the August 11 meeting was one regarding the June 29 meeting during which the Board interviewed a total of four applicants including the most recent town counsel. The complaint read, “Considering that the Board of Selectmen chose to advertise, interview, and appoint a new person into this position, should there not have been some discussion from the members of the Board of Selectmen as to how and why they came to their decision.” The complaint asked that the Selectmen explain their decision and the reason behind it. Again, they voted to send the complaint to Brooks and DeRensis to be investigated.

At the conclusion of the discussion on the complaints Seelig said, “Mr. Chairman, may I say something?” Andrews responded, “No, we are going to move on.” Seelig then responded, “I’ll send a letter directly to the Board and to your Counsel.” Prior to adjourning, it did appear that someone in the audience attempted to speak. Andrews responded, “We don’t have any public comment right now.”

Mask policy stays for back to school

The Silver Lake Regional School Committee held a joint meeting with Union 31 as well as Dennett and Halifax School Committees on August 10. Vice Chair Eric Crone led the Silver Lake School Committee and chaired the meeting as Chair Paula Hatch was having technical difficulties. Sheila Vaughn called the Kingston Elementary School Committee meeting to order, Summer Schmaling the Halifax Elementary School Committee meeting, and  Jon Wilhelmsen the Plympton Elementary School meeting.

Superintendent Jill Proulx offered to begin with an explanation of the latest guidance from the Department of Elementary and Secondary Education (DESE) and the Department of Public Health (DPH). Proulx said that both Departments “strongly recommend that all students in kindergarten through Grade 6 wear masks when indoors except students who cannot do so due to medical conditions or behavioral needs.” She said that they noted that masks aren’t necessary outdoors and may be removed to eat indoors. Both departments also strongly recommend that masks be worn by all unvaccinated inhabitants of the school regardless of whether they are staff, student, or visitor. “Any child or family member who chooses to mask should be supported in this choice,” Proulx read from the guidance. All staff and students are mandated to wear masks on school buses and in a medical setting.

Proulx said that a new test and stay protocol will soon be released by DESE and the DPH which will allow asymptomatic close contacts to remain in school while being tested daily rather than quarantining at home. Vaccinated staff and students will be exempt from quarantine. Proulx told the school committee members that they had also been provided with a letter from the school pediatrician as well as links to the masking recommendations from the American Pediatrics Association, the CDC, and the Massachusetts’ Association of School Counselors. “All advocating, in their own language, for universal masking in schools regardless of vaccination status,” Proulx said.

An attorney was present to discuss recommended policy changes. He said that the Committees present could make a determination that night regarding masking that would fall into one of three categories. The first would be universal masking, the second would be to adopt DESE guidelines, and the third would be not to require masks except for school transportation and the public health department. He said that he has had discussions with DESE on two issues, the first being the right to adopt masking policies more stringent than that required by them (this is allowed) and the second is in regard to student discipline when a student is required to but refuses to wear a mask. “The legal department of DESE has told me that they will be issuing additional recommendations and guidelines,” he explained. He further said that special legislation mandating universal masking may be forthcoming though he noted he did not know if it would pass and if the Governor would sign it. He advocated for the Superintendent to be given the authority to make changes as necessary.

Crone then opened the discussion to questions and comments from the various committees alternating between them. Andrews began asking, “If we go with a non-mask requirement and parents do not feel like they can send their students to school without everyone being required to wear masks, what are we required to provide for them – anything at this time?” The attorney responded that the child would be truant in that case. The flipside of that would also be true where if a mask is required as a policy and a caregiver elects not to send their child due to that policy, that child would also be truant. Andrews pointed out that if enough children did not attend school, that day would not count.

Vaughn said that the Kingston Board of Health just voted to mandate masks. The attorney said that as far as he knew, the Kingston Board of Health did not have the authority to mandate masks in schools. He said he would have to confer with DESE and the Massachusetts Department of Public Health to clarify. Timothy Lewis, with the Kingston School Committee, asked the attorney for his opinion on DESE’s recommendation. After clarifying that he was there more to offer legal counsel than opinion, the attorney stated, “The clearest policy and provides the greatest defense is universal masking.” Referring to no masking, he said it “does raise legal risk because even though permitted it is not recommended and it could result in greater legal liability for the school district.”

Silver Lake Regional School Committee member Gordon Laws asked the attorney to elaborate on the extent to which the District would be liable based on different scenarios. “I think that there really is no realistic threat if you either have universal masking or follow the DESE or DPH advisory because those are state sponsored and you have a right to follow the guidance of your state,” he said. He elaborated that were you to make policy less than that required by the State you could possibly be liable. Of the 17 school districts represented by the attorney he said none had thus far voted to not even recommend masks.

During Plympton’s opportunity to speak, Chair Jon Wilhelmsen said, “I’ll just make one point this time around… I think we’re all looking at the guidance right now and talking about the Superintendent having the ability to react to the different guidance; it’s not just about ratcheting up measures… but it’s also, as we hopefully get things under control, to be able to relax standards.” He said that would allow for quicker decisions instead of waiting for a School Committee meeting to be scheduled and held.

Silver Lake Regional School Committee member Emily Davis said, “I’m very uncomfortable that we’re even having this discussion.” She was referring to feeling like it was odd that they were discussing public health as members of school committees. The attorney said that he agreed and the State should really be telling schools what to do. He said if legislation goes through that is what will happen.

Halifax School Committee member Lauren Laws asked if they elect to follow DESE recommendations, how will they enforce who is and isn’t vaccinated. “As far as getting proof of vaccination, we have no legal right to do that with students or teachers or staff and that’s because of HIPPA,” the attorney explained. He said you can ask about vaccination status but you cannot require proof. “That’s one reason why some places are going to universal masking,” he added.

Timothy Lewis of the Kingston Elementary School Committee made a motion that their Committee rescind the masking policy. Committee member Jeanne Coleman seconded the motion. The motion was to rescind the current policy with the intention to vote through a different policy at a later date. Coleman said she was unsure why there was a need for any policy whatsoever beyond following the guidance of DESE. The attorney said that previously some school districts didn’t adopt a policy because there was a mandate in place. He said that the administration would have to put together a note to families letting them know that they are acting in accordance with DESE’s guidance. The Kingston Elementary School Committee voted to rescind their previous masking policy.

Plympton School Committee member Jason Fraser said that in light of DESE most likely coming out with further guidance, “I think it makes sense for us to table any ideas of making any further motions tonight for the Plympton School Committee.” The attorney forewarned that taking no position assumes that DESE will do what they said they are going to do, particularly before the start of the school year. Wilhelmsen pointed out that for Plympton, Proulx already has the ability to amend their policy based on whatever guidance comes out from DESE. Another member clarified that Plympton’s current policy mandates masks as it calls for following multiple sources including the CDC who is calling for a mandate. Fraser said, “I’m not comfortable making those medical determinations having these authorities over us including the District doctor now saying that he thinks all of our students should be masked in order to protect all of our vulnerable students and staff… this is a very confusing conversation and topic at this point and I would like to defer to those public health officials.” Fraser said that he wanted to leave what they had on the books while calling for a meeting prior to the start of school. Nicole Mahoney said that she respectfully disagreed. Mahoney said that she wished to rescind their policy in good faith that they would meet again before school reconvenes. Amy Hempel seconded Mahoney’s motion to rescind. The Committee voted unanimously to do so.

Schmaling made a motion for Halifax to rescind the policy requiring face coverings. Several members of the Halifax Elementary School Committee, including Schmaling, spoke out vehemently against requiring all students to wear face masks. Lauren Laws clarified that the vote they would be taking would only rescind the current policy as she said she would like to see them put a policy in place at a later date. “I feel like last year’s school was very successful because the kids were masked,” Laws said. With respect to another member’s claim that some of the Committee members calling for masks in school have been openly doing things on social media without masks, Laws said, “you know, everything you talked about was outside.” She added, “There are changing parameters right now that I feel like need to be watched.” Schmaling clarified that in rescinding their policy they are following DESE’s guidance. The vote to rescind the current policy was unanimous.

Silver Lake Regional School Committee then began their discussion. Committee member Christopher Eklund made a motion asking for Silver Lake to adjourn saying he no longer felt the format of the current meeting was conducive to conducting business. He recommended they reconvene before the start of school. Committee member Leslie-Ann McGee seconded that motion. Crone clarified that this would leave the current policy in place which requires masking but gives Proulx the ability to make amendments to the policy as she deemed fit provided it complies with CDC, DESE, and DPH guidance. Crone said he agreed with Fraser that they need to see what new guidance or mandates come down the pipeline prior to the start of school. The attorney clarified that if they didn’t meet to put a new policy in place, Proulx would be forced to go with the most stringent of guidance.

The Silver Lake Committee then took a vote to adjourn leaving the current policy requiring masks in place with the intention of meeting again before the start of the school year. No votes came from Paula Hatch, Lukasz Kowalski, Schmaling, and Davis. Yes votes came from Gordon Laws, Fraser, Eklund, McGee, and Crone. With votes weighted differently depending on town, the vote ended in favor of adjourning the meeting with the current policy still in place.

Vaughn asked that the Kingston School Committee stay on. Kingston Elementary School Committee member Cowett then made a motion that Kingston align its recommendation with respect to masking in schools with that of DESE. They voted unanimously in favor of Cowett’s motion. Halifax made a similar motion that was also voted through unanimously.

There was also a reorganization of Union 31. There was a motion and a second to appoint Gordon Andrews as Chair and it was voted through unanimously. Summer Schmaling was nominated for Vice Chair and like Andrews, voted through unanimously. Michael Cowett was nominated and voted in as Secretary of Union 31.

BOS reconsiders Green Earth Cannabis vote

The Halifax Board of Selectmen held a brief meeting on Friday, August 6 to reconsider a previous vote. Selectmen Chair Gordon Andrews and Selectman Troy Garron were in-person and Selectman Ashley DiSesa was participating remotely.

Aside from Executive Session, on the agenda was the reconsideration of a vote from their June 11 meeting not to enter into a Host Community Agreement (HCA) with Green Earth Cannabis, Inc. Andrews recused himself from the initial vote as well as the reconsideration as his father owns property within close proximity to the proposed lot. On June 11, Garron said that he had heard from many residents who opposed the establishment.

Director of Operations for Green Earth Cannabis Robert Maker had appeared before the Board of Selectmen during their July 13 meeting to plead his case and ask them to reconsider their decision. Maker said he has lived in town for 27 years and asked the Board to consider his ties as well as his contributions to the community over those years. Maker had also said that they hoped to create jobs for local Halifax residents. “We are preparing to mitigate whatever impact the facility may have on the neighbors,” Maker had also said at the time.

Town Administrator Charlie Seelig explained at the Friday meeting, “If the Board rescinds its previous vote from June 11, we’re basically starting from that point where the Board has not made any decision. A person or entity is entitled to appeal an action taken by a municipality within 60 days of said action. As the 60-day deadline is this week, Green Earth Cannabis does not need to file suit against Halifax as long as the Board of Selectmen vote to rescind their decision not to sign the HCA. This saves on legal costs for both sides.

DiSesa confirmed with Seelig that if after going through all the motions, they could still decide against entering into an HCA with Green Earth. Seelig assured her that they could. A public forum/ hearing on the HCA will likely be scheduled for later this month. If, after that forum, the Selectmen still decide not to sign the HCA, Green Earth will have the opportunity to appeal the decision. Garron made a motion to rescind their previous vote and DiSesa seconded making it unanimous.

Carver cosiders Plympton’s needs in Urban Renewal project

The Plympton Board of Selectmen met virtually on Monday, August 9. They began with an update on the Carver Urban Renewal Project. Both Selectmen Chair Christine Joy and Selectman Mark Russo attended the most recent meeting for the project.

Joy said that her biggest takeaway from the meeting was that the project would entail a 24/7 operation. Joy also said that the Redevelopment Authority as well as the Department of Housing Authority would have control over the project. She said they are working on getting a consultant for the project and added, “At this point everything is really conceptual; they’ve got quite a bit of work to get where they want to go.”

Another noteworthy takeaway from the meeting was that if the height of the building was extended to 60 ft. there would be an additional 100 ft. setback added as well. “So that was good to hear,” Joy said. “I was very happy with the level of concern that they gave to Plympton residents,” she explained saying that she and Russo were both allowed to speak during the meeting. According to Joy, Plympton will be allowed to talk to the developer to stay abreast of the plans. Plympton will also be kept informed of future meeting dates.

Russo added, “I was very appreciative of how willing they were to listen.” He said he was particularly appreciative of their awareness of the effect the project would have on Plympton residents. Russo also said that he spoke to a Conservation Commission member who thought it might be possible to have a consultant to the developer hired for the abutting town to address issues like wastewater disposal and wetlands. He said he would look into the possibility.

Bridge projects: Ferguson and

Winnetuxet bridges

Highway Superintendent Rob Firlotte was in attendance and provided an update on state bridge projects.  Firlotte said that they were planning on doing some structural testing with the grant for the Ferguson Memorial Bridge on Route 58. He said they were thinking about a scheduled replacement in 5-7 years.

Regarding the Winnetuxet Bridge, Firlotte said that one change that they would like to make is to widen it a bit and to allow for some kind of sidewalk. All at the meeting agreed that they wouldn’t want to move away from a wooden bridge. They all agreed that they were happy that the State was open to their feedback. Selectman John Traynor said he was “afraid at some point in the process they’ll throw a switch and we’ll find ourself with a totally different bridge.” Firlotte noted that he didn’t expect to incur any costs on the project calling it “almost like a State gift.” He also said the work to the wooden bridge wouldn’t occur for several years.

Beer Garden Licenses

The Selectmen met with Mike Johnson and James Wright who own Brewery 44. They explained that they had approached Sauchuk Farm with the idea of doing a Beer Garden. Johnson and Wright explained that the concept has become quite popular recently. They described it as providing people a chance to sample a few beers while expanding upon their market base. Their intent would be to setup a pop-up tent area with two beers and a seltzer to sample during the hours of operation from 12 p.m. to 5 p.m.. They were applying for 13 individual liquor licenses for every Saturday and Sunday up to but not including October 31.

Russo explained that he was concerned that a precedent not be set were the licenses to be issued. He also said that he would feel more comfortable issuing just a few licenses to ensure that no problems arose. Joy agreed with Russo. The Board voted to approve the first 4 licenses.

Covid cases increasing in town

Town Administrator Liz Dennehy was absent from Monday’s meeting so Joy provided her update. She said that Covid cases were starting to pop back up in town with three recorded since August 5. She noted that as of yet, there were no plans to change any of the protocols in place. She did, however, note that some towns are starting to issue mask mandates in public buildings. The plan will be to watch and see what develops over the next several weeks.

Town House WiFi

Joy also said that there was an inquiry out currently with Comcast to try and figure out a plan for establishing Wi-Fi at the Old Townhouse. For correspondence, the Selectmen approved the use of the town green for a wedding. “Good luck to the couple that wants to get married,” Russo said cheerily.

40 child increase at Dennett

Chair of the Plympton School Committee and Chair of the Town Properties Committee Jon Wilhelmsen gave a brief update on the schools saying that more would be known regarding safety protocols after the Silver Lake Regional School Committee meeting the following evening. He did note that there would be an extra 40 children in the Dennett this year as the outgoing class was small and the incoming class quite large. Regarding the new playground project, Wilhelmsen said the old playground had been removed and the hope was to have the new one installed in time for the start of school. Siding has been replaced on the side of the building facing the parking lot. The parking lot has also been redone.

Wilhelmsen also provided an update on the Town Properties Committee. He said they “need to take a little time and look at recreation because when we do the plan it impedes upon the existing ball fields.” He said that as part of Phase 2 the Committee plans to get an idea of what the costs are as well as how it will all fit together.

OCPC to help with truck traffic

Old Colony Planning Council (OCPC) continues to pursue restrictions on heavy truck traffic on certain roads in Plympton. Dennehy is working with Kingston on how to alleviate it on Ring Rd. Russo noted that he would like to see this project moved along quickly.

North Plympton Cemetery

Traynor gave an update on a clean-up event that he had hoped to have at the North Plympton Cemetery. The plan was to have the Boy Scouts assist. He said he had a lawyer draw up a release for the 15 acres the cemetery sits on but told the Selectmen that the woman who owns the property refused to sign it. Traynor said he will be pushing the project off to the fall but noted he plans to take pictures to show how overgrown it has become.

Raves for COA

Traynor also praised the Council on Aging (COA) saying that more and more events were being held. He praised the leadership of both Director of Elder Affairs Colleen Thompson and Chair Nancy Butler and said that he believed the COA was finally becoming what the town had always hoped it would become.

Brown water is safe to drink

The Halifax Board of Selectmen met virtually on the evening of Tuesday, July 27.

Water System Discussion

Selectmen met with the Water Commissioners and the Board of Health to discuss the water system. Selectmen Chair Gordon Andrews explained that a resident had attended a previous Board of Selectmen meeting to complain about the state of the water supply to her home. The resident had provided the Board with photographs of brown water. Andrews asked if someone could provide some clarification on the discolored water. A member of the Water Commissioners responded, “I know that specific development that she lives in; it’s because of what the water main is in.  it’s an eight-inch water main going in with a two-inch main coming off and a dead end.” He said the building maintenance company was supposed to go in and do something since the Water Commissioners cannot go in and flush. He said the company was not flushing as often as they should be. Andrews asked if the water was safe and was told it was. The resident asked if it was just the condos, why was brown water being seen in other areas in town. The Water Commissioners acknowledged that the town may not have been doing their due diligence regarding flushing in the past and stated that there is a new Superintendent in place as of the last three weeks. “We know there’s been a problem with flushing and we’re going to correct that,” the member of the Water Commissioners stated. “Thank you for taking some ownership,” the resident said. Someone asked if the discoloration could be rust from older pipes. The Water Commissioners said they didn’t believe that to be the case.

The Water Commissioners insisted that if a proper flushing job was completed then “ninety percent of these problems will go away.” Selectman Ashley DiSesa pushed for an answer regarding when residents would begin to see improvement but an answer was not given. DiSesa also asked if they would be willing to go out to the condos and investigate and was told that they would.

Zoning Bylaw Review Contract

Seelig told the Board of Selectmen that if they wished to make amendments to the proposed contract, they would need to be sent to Attorney Mark Bobrowski soon. “I did talk to the Finance Committee about this last night; they’re welcoming other Boards, Committees, and town officials to participate in this project with the anticipation that the work reviewing and revising the contract moves ahead,” Seelig explained. Andrews said that his concern was that the Finance Committee, through their own admission, does not have the expertise necessary to do the work. He noted that they are not getting the needed outside participation at their meetings. “I think we should consider revamping the bylaw subcommittee and assigning them to work on this task with Attorney Bobrowski,” Andrews recommended. Andrews said that thus far it is really just Attorney Bobrowski providing recommendations on what he sees could be done differently. DiSesa agreed with Andrews. “And who would you put on that Committee?” Selectman Troy Garron asked. DiSesa replied that she would like to see someone from Zoning and Planning. Seelig said that previously there were members from Zoning, Planning, the Selectmen, the Building Inspector, and some members at large.

“I know obviously a number of people opposed this project at Town Meeting back in September; I’m not quite sure that it would be normal to have people that oppose the project and voted against it to be on the same Committee that actually is trying to get the work done,” Seelig said. Andrews disagreed saying, “Except those are the people that you need to get buy-in with two-thirds of the vote.” Seelig asked what would be preventing those against the project from sabotaging it. DiSesa said she felt the necessary checks and balances would be in place. A motion was made to revamp the bylaw subcommittee. It was voted through with Garron abstaining.

Appointment for Live Entertainment Permit

The Board met with David and Linda Tonioli who were seeking the permit for August 14 from 3 p.m. to 9 p.m. Andrews confirmed that they had already verified that a Police detail would not be necessary. DiSesa asked if they would have enough space for parking and was assured that they would. “Our invitations are in the mail?” Garron joked. The Board voted unanimously to approve the permit.

Council on Aging Coffee Group

Seelig said that while a men’s coffee group has been in place for a number of years, they have only recently organized a woman’s one. He said it was great to see more activities happening under the new COA Director. The new Director spoke saying, “In order to increase the awareness of the COA, what has been difficult of course is finding the resources to be able to hold the events. We have so much energy here, tons of energy, I don’t want to squash that energy – I want to create more programs.” Officer Cushman has been invited to the event. “The community is very supportive of one another and you don’t see that often,” she said.

Seelig said that the Board would need to decide whether or not to allow comments from the public as they would need to be moderated if they were allowed. If not allowed, it would simply be a means of posting information to the public. “So, I think posting onto Facebook to share information is good; I think it creates issues if you’re going to have more than one person comment back because if two members of a three-person Board comment back, that’s a violation of an open meeting law,” Andrews said. Seelig said he was more interested in whether or not to allow comments from the general public. DiSesa said that she didn’t necessarily think comments should be allowed but said she did feel that messages should be allowed. Andrews said he felt that they needed to have a policy in place and recommended speaking to the town attorney to see if they have a social media policy to recommend.

ZBA Appointment

Seelig asked the Board if they wished to make an appointment to the Zoning Board of Appeals (ZBA). Garron said he wished to nominate Daniel Borsari. DiSesa said she felt that applicant Tina Kenyon had the qualifications necessary. “It would be nice to see a mom on the Board with all of her education and background in real estate,” DiSesa said. Garron agreed to second the motion to make Kenyon the newest member of the ZBA. Andrews recused himself.

Department Head Meeting

Andrews explained that they had invited all of the various department heads to see if there were any unforeseen issues, etc. that they wished to discuss. The Board of Health led things off saying that as of right now their budget looks secure but noted that it was dependent upon what happens this fall. Board of Health Agent Bob Valery noted that the town was currently on an increase regarding Covid. He also noted that he’s had more tick bite cases than Covid cases in the last month and said that mosquitos are likely next. DiSesa thanked Valery and the department for all of the extra work that was required in the past year.

Police Chief Joao Chaves provided an update on his department saying, “things are good budgetary-wise.” He also noted that staffing was finally at one-hundred percent. An article will be on the warrant for Town Meeting to remove Halifax from civil service. He noted that it was supported by both unions. “I think for a department our size, it makes all the sense in the world,” Chaves explained. He said that a new program will be put in place where any home that has an autistic child living in it, the family will be provided with a decal for either their home or car. The Department will also participate in a litter program where the officers will be given gift certificates to be handed out should they come across someone cleaning litter. Another program will provide care packages available for children ages 0-12 should they find themselves at the station.

Halifax Elementary School Principal Kayne Beaudry spoke next. “The school is actually, finally quiet for once,” he said laughing. He said the custodians were doing a deep clean of the building to make it ready for the fall. He also gave a rundown of several projects that were underway including putting AC into several areas of the building. Beaudry noted that they had no idea what kind of restrictions will be mandated come the fall.

John Shiavone spoke next on behalf of the Board of Assessor’s. He said the Assessor’s Office should be able to level fund any budgetary matters. He also said they weren’t anticipating any additional requirements for equipment.

Highway Surveyor Steve Hayward provided an update on the Highway Department. He said he would be losing a part-time recycling employee. A mechanic will also be leaving soon. He said they are working on a job description. He provided an update on the cremation garden, saying that 7 lots were sold. A new section is now open and already a burial has occurred.

Holmes Public Library Director Jean Gallant spoke next. “The library is doing well… we’ve made some adjustments to our summer reading program,” she said. She noted that they were very busy and said that they were holding most of their programming outside. She said she is down one 35 hour per week position which she hopes to fill in September. Gallant said she is in the middle of writing a 5-year strategic plan. Gallant said they are also working on a grant to design three new spaces in the library including the toy room.

Treasurer/Collector Pamela Adduci said that cash flow was good in their office. She said they were waiting on word from the Selectmen to send out the recycling bills. Town Accountant spoke on the heels of Adduci saying this was probably the busiest time of year for her as the office closes out FY2021 and opens FY2022.

New Council on Aging (COA) Director Darlene Regan also provided an update. Regan said that the senior center opened on June 28 noting that everyone was “pretty excited to the point where it was difficult to keep up…. you know, in a safe way.” She said she reached out to Valery regarding safety measures including mask wearing in a small environment. She said that they have rebranded a bit in the hopes of reaching out to not only the senior community but their caregivers as well.

Cesar Calouro spoke on behalf of Information Technology. Calouro said he began his 40 hour a week position the previous week and noted that he was able to get their email security system setup. “We’ve also started to implement our new backup solution to our servers as well as dedicated workstations across the town,” he explained. He said that as of right now the only system being backed up properly is the one at Town Hall. Andrews recommended having a meeting dedicated to the IT issues throughout the town. “I know there are a lot of issues and I appreciate everyone’s patience… it does take time, I wish I could do everything with the snap of a finger but I’m not a magician,” Calouro said.

Town Clerk Susan Lawless said that their office has been quite busy and noted that dog licenses are now past due. Lawless also said that they sent out a mass inactivation for people who did not complete their census. She said their voter registration becomes inactive. She said they sent out a postage paid postcard that they just need to sign and send back to verify that they are still living in town.

New Town Counsel Paul DeRensis introduced himself to those gathered.

Other News

Police Chief Chaves made Seelig aware of some valiant actions on the part of one of the town’s officers. “Officer Hingst was able to diffuse the situation and help both the individual and the family… the Chief wanted to make sure that the public was aware of Officer Hingst’s work,” Seelig said.

Garron recommended sending a letter to Hingst.

Seelig said that the Assistant Building Inspector had resigned and asked the Board if he should move forward with the process of finding a new one. The Board confirmed that he should.

Seelig mentioned that the Board has been dealing with a number of complaints and inquired as to whether or not they wished to formalize the process. “I think that we’ve got a new firm with Brooks and DeRensis to reach out and talk to about policies they can recommend,” Andrews said.

Seelig said that he has been asked what steps the Board of Selectmen intend to take to address the lowering of morale that has occurred in the last year. “I think by having these open meetings with department heads – getting people together with the understanding what everyone’s going through with their issues,” Andrews said.

DiSesa said, “I think it’s important that everyone work together… I get that people don’t like change… and there’s been a lot of change in this town in the last couple of months but I think change can be good sometimes and I think if everyone has an open mind about things and works together that will help the morale.”
